Short answer: in both the United States and the European Union, an electronic signature generally cannot be rejected just because it is electronic. But that does not mean every typed name, checkbox or signature image will be equally easy to enforce.
The software is only one layer. A defensible electronic agreement also depends on whether the signer intended to sign, whether the parties agreed to transact electronically, whether the record can be retained and reproduced, and whether the evidence reliably connects a person to the action.

Research conclusion
For routine business agreements, electronic signatures are widely recognised in the US and EU. The strongest practical conclusion from the primary sources is not that a particular drawing of a signature has special power. It is that businesses should preserve a reliable chain of evidence around the transaction.
For a small company, that normally means checking five things:
- Intent: did the signer take an action that clearly indicated an intention to sign?
- Consent: did the relevant parties agree to use an electronic process?
- Identity and attribution: what connects the action to the claimed signer?
- Integrity: can the business show that the completed record has not been altered?
- Retention: can the final agreement and its supporting evidence be retrieved and reproduced later?

What US law actually says
The federal Electronic Signatures in Global and National Commerce Act, usually called the ESIGN Act, establishes a broad rule for interstate and foreign commerce. A signature, contract or record may not be denied legal effect, validity or enforceability solely because it is electronic. A contract may not be denied legal effect solely because an electronic signature or record was used in its formation.
That is the foundation—but it is not a guarantee that every electronic transaction will be enforceable.
The same statute preserves other legal requirements. It does not force a person to use or accept electronic records. It contains additional consumer-disclosure and consent rules in certain circumstances. It also says that when information must be provided in writing, an electronic record may need to remain in a form that is capable of being retained and accurately reproduced.
The official US Code text for 15 U.S.C. Chapter 96 should therefore be read as a technology-neutral legal baseline—not a certification of an individual platform.
Most US states also use the Uniform Electronic Transactions Act, or a related state framework. The exact rule can vary by state and transaction type, so businesses should not reduce a nationwide workflow to the sentence “ESIGN makes everything valid.”
Four practical questions under the US framework
1. Was electronic business agreed to?
The ESIGN Act does not require a person to accept electronic records. For ordinary B2B work, consent may be reflected in the parties’ conduct and the signing flow. Consumer transactions can trigger more specific disclosure and consent requirements.
2. Did the person intend to sign?
The legal definition focuses on an electronic sound, symbol or process attached to or logically associated with a record and executed or adopted with intent to sign. This is why the surrounding workflow matters. A deliberate “Finish” or “Agree and sign” action is more informative than a signature image found in isolation.
3. Can the action be attributed to the signer?
An email address alone may be persuasive in a low-risk transaction, but it may be weak evidence if several people share an inbox or if credentials are compromised. Passcodes, two-factor authentication, identity checks, timestamps and IP or device evidence can strengthen the factual record. Which level is proportionate depends on the value and risk of the agreement.
4. Can the record be retained and reproduced?
The final agreement should be available to the parties entitled to retain it and capable of accurate reproduction. A business should test export and retention before it depends on a platform—not after a dispute, cancellation or staff departure.

What EU law actually says
The EU’s eIDAS framework distinguishes between different levels of electronic signature.
- An electronic signature is the broad category.
- An advanced electronic signature must satisfy additional requirements linking it to the signatory, enabling identification, keeping the signature under the signatory’s control and making later changes detectable.
- A qualified electronic signature adds a qualified certificate and a qualified signature-creation device.
The central rule is nuanced: an electronic signature cannot be denied legal effect or admissibility as evidence solely because it is electronic or because it is not qualified. However, a qualified electronic signature has the equivalent legal effect of a handwritten signature across EU member states.
That does not mean a standard electronic signature is “invalid.” It means the legal presumptions and evidential strength are different. The original framework is set out in Regulation (EU) No 910/2014, while the updated European Digital Identity framework is reflected in Regulation (EU) 2024/1183.
The EU framework also does not replace national rules about whether a particular transaction requires a special form. Employment documents, property transactions, guarantees, regulated financial activity, family law and public-sector procedures may require additional analysis.
The implication for a small EU business
Do not ask only, “Does this tool support e-signatures?” Ask:
- What signature level does our workflow create?
- Does this document type require a qualified signature or another special form?
- How is the signer identified?
- What evidence is included in the completed record?
- Can we export and preserve that evidence for the full retention period?
A signature image is not the whole evidence package
The visible signature on a PDF is only the most recognisable part of the process. If an agreement is challenged, the surrounding evidence may be more important:
- the email address or phone number used for delivery;
- timestamps for sending, viewing and signing;
- authentication events;
- a history of changes and actions;
- the completed document hash or tamper evidence;
- the exact wording of the consent and signing action;
- the final audit certificate or audit trail;
- proof that the signer could download or retain the record.
This is why a useful e-signature evaluation should focus less on how attractive the signature field looks and more on what the platform records, exports and protects.

The plan-selection trap: buying for volume instead of risk
Small businesses often compare e-signature plans by the number of documents they can send. That is useful, but incomplete.
Imagine two workflows:
- A photographer sends a low-value model release to a known returning client.
- A staffing company signs a high-value agreement with a new overseas customer and grants access to confidential data.
The second workflow may justify stronger signer authentication, controlled team permissions and a more formal identity process even if it sends fewer documents.
This produces a better selection rule:
Choose authentication and evidence controls according to the consequence of a disputed signature—not only the number of envelopes you send.

Send the sample to an address you control. Record every step the recipient sees. Is the action that constitutes signing clear? Is consent obvious? Can the recipient decline?
2. Inspect the completed evidence
Download the final document and any separate audit certificate. Identify exactly which events, timestamps and authentication details are recorded.
3. Test tamper detection
Keep the untouched completed file. Make a copy, alter the copy and observe how the software or PDF reader indicates that the document changed. Do not assume the phrase “tamper-proof” explains the mechanism.
4. Test account and signer authentication separately
Login 2FA protects a staff member’s account. Signer 2FA helps authenticate a recipient. They solve different problems. Confirm which one your chosen plan includes.
5. Export without relying on the dashboard
Download the agreement, audit evidence and a useful index of its status. Consider how your company would find the material after an employee leaves or a subscription ends.
6. Check the excluded-document list
Ask counsel or the relevant authority whether the document type has special form, witnessing, notarisation, identity or retention requirements. This is especially important for cross-border and regulated transactions.
7. Document the internal process
Write a short policy defining who may send agreements, which authentication level applies by risk, where completed files are stored and how long they are retained. Good software cannot compensate for an undefined process.

When to look beyond Signeasy
Signeasy should not be chosen solely from a general “legally binding” statement when the workflow requires:
- a qualified electronic signature under EU rules;
- notarisation, witnessing or a jurisdiction-specific formality;
- specialised identity-proofing standards;
- a regulated archival or data-residency arrangement;
- evidence or certifications not included in the selected plan;
- a complex contract-lifecycle system that exceeds the documented workflow.
In those cases, create a requirements list first and ask the vendor for written confirmation. If the issue is legally consequential, obtain advice for the exact jurisdiction and document type.
Final verdict
Electronic signatures are not legally effective because a platform draws a cursive name on a PDF. They are effective within a legal and evidential process.
The US ESIGN framework protects electronic records and signatures from rejection solely because of their form. EU eIDAS rules do the same while giving qualified electronic signatures a specific equivalence to handwritten signatures. In both systems, the practical strength of a transaction still depends on consent, intent, attribution, integrity, retention and any document-specific rules.
